Council's Successful Licensing Prosecution

Premises Licence holder Michael Palmer of Piccotts End pub the Boars Head was convicted yesterday (6 September) at Watford Magistrates Court for breach of Premises Licence conditions. This occured when a jazz band were performing at the pub in June.

Mr Palmer is the Designated Premises Supervisor and sole director of the company on the licence as the Premises Licence Holders of the Boars Head public house at Piccotts End, Hemel Hempstead. One of the  conditions attached to the Premises Licence is that at all times when live music is being played all doors and windows must be kept closed.

On the evening of Tuesday 29 June 2010 a jazz band were performing live music at the Boars Head. A complaint about the noise from the music being too loud was received by the Police. When the Police attended they saw the front door and windows were open. Mr Palmer was therefore in breach of this condition.

The offence of carrying out a licensable activity other than in  accordance with an authorisation, is contrary to Section 136 (1) (a)  of the Licensing Act 2003. As a result of this Mr Palmer was interviewed by Police and the Council. Dacorum Borough Council summoned Mr Palmer to Court, where he pleaded guilty to the offence. He was fined £500 with costs of £300 and victim surcharge of £15
Councillor Colette Wyatt-Lowe, Portfolio Holder for Residents and Regulatory Services, said: "In the interests of the public, the Council will not hesitate to take action against licensees who flout their Premises Licence conditions. I'd encourage any licencee who is unsure about their Licence conditions to contact the Council on 01442 228470."
